Welcome to Kanoa

By using our website, mobile services, or booking our vacation gear delivery, you agree to the following terms. We’ve written them in a straightforward way so you can feel confident and informed when renting from us.

Agreement to Terms

By checking the box “I agree to Kanoa’s Terms and Conditions” during booking or completing your reservation, you acknowledge that this action constitutes your electronic signature and your full agreement to be bound by all Terms and Conditions listed below. This consent confirms that you have read, understood, and accepted these Terms, including all policies related to rental eligibility, moped requirements, cancellation, liability, and payment authorization.

Eligibility and Booking Requirements

Kanoa is a vacation gear rental service operating in Hawaiʻi. All bookings must be placed through our official platform. You must be at least 18 years old to rent with us, and you’ll need a valid credit or debit card to complete your booking. We rely on the accuracy of the information you provide, including your contact details and delivery address, so please double-check everything before confirming your order.

Delivery and Same-Day Bookings

Once your rental is confirmed, we’ll deliver your selected gear to your location and return to pick it up at the time you’ve scheduled. For same-day bookings, please note that your selected delivery time must be at least 30 minutes from the time of booking. We cannot guarantee immediate availability for last-minute requests.

Proper Use of Equipment

We expect our gear to be used safely, legally, and as intended. You agree not to misuse, modify, or damage any rented item. If an item is lost or returned in poor condition, we may charge a fee to repair or replace it. You authorize Kanoa to charge the payment method used at booking for any costs associated with loss, damage, or non-return of rented equipment. For moped rentals, additional terms apply. Please see the section below titled “Moped Rentals, Identification Form & Liability Waiver.”

Moped Rentals, Identification Form & Liability Waiver

Moped rentals are governed by the Moped Rental Agreement & Liability Waiver, which will be emailed to you after your booking is confirmed. You must complete and submit this form before delivery or pickup. Failure to do so may result in cancellation of your booking without refund.

The signed Moped Rental Agreement & Liability Waiver will govern your rental and, in the event of any conflict, the terms of that Agreement shall prevail over these Terms and Conditions.

Identification Requirements

  • A valid government-issued driver’s license.
  • Confirmation of your completed waiver form.

Use Restrictions

  • The moped must be used only for lawful personal transportation on properly maintained roads and parking lots.
  • Operation on freeways, highways, sidewalks, or pedestrian paths is prohibited.
  • Passengers are not allowed.
  • The moped must be returned to the scheduled pickup location provided at the time of the initial order/rental.

Safety and Protective Gear

Operating a moped carries inherent risk. You agree to operate safely and comply with all Hawaiʻi traffic laws. Kanoa Rentals LLC strongly recommends wearing personal protective equipment (PPE) including helmets, safety glasses, and gloves.

By proceeding with the rental, you acknowledge these risks and agree that failure to use proper PPE is at your own risk. Kanoa Rentals LLC shall not be liable for any injury, loss, or damage resulting from failure to wear PPE.

Indemnification and Liability

You agree to indemnify, defend, and hold harmless Kanoa Rentals LLC, its members, managers, employees, and affiliates from any and all claims, damages, or costs (including attorney’s fees) arising from or related to your possession or operation of the moped.

You waive all claims against Kanoa Rentals LLC for personal injury, property damage, or consequential losses incurred during your rental period.

Liability for Damage, Loss, and Insurance Option

  • Standard Liability: You are fully responsible for any and all damage to, loss of, or theft of the moped or its accessories, regardless of fault.
  • Insurance Package: Optional insurance is available for $25 per day, covering accidental damage, loss of equipment, or breakage, subject to a $500 deductible per incident. This includes roadside assistance in the event of a breakdown or accident.
  • Theft Exclusion: If the moped is stolen, you remain liable for the full replacement fee of $1,000 or the model’s designated replacement value, whichever is greater.

Fuel Policy

  • Mopeds are provided with a full tank of gasoline (premium or as labeled).
  • You must return the moped with a full tank of the same fuel type.
  • If returned with less than a full tank, you authorize Kanoa Rentals LLC to refill the tank and charge a $10 refueling fee plus fuel cost.
  • Using the wrong fuel type (e.g., regular instead of premium) that causes damage will result in full repair costs charged to you.

Condition & Return Policy

  • The moped and all included items (helmet, accessories) are inspected and in good working condition at the start of your rental.
  • You must return them in the same condition, ordinary wear and tear excepted.
  • A 15-minute grace period is allowed beyond the scheduled return time. After that, a $25 late fee per additional hour (or portion thereof) applies.
  • Extensions must be requested and confirmed by a Kanoa Rentals LLC representative at least one (1) hour before the scheduled rental end time.
  • Failure to return the moped within 24 hours may result in replacement charges.
  • Lost keys, helmets, or accessories will be billed at replacement value.
  • A $15 cleaning fee may be charged if the moped is returned excessively dirty (sand, mud, or debris).

Unauthorized Riders

Only the renter listed on the agreement may operate the moped. Allowing another person to operate the vehicle voids any coverage and results in full responsibility for all damages or loss.

Automatic Charges

You authorize Kanoa Rentals LLC to charge the payment method used at booking for any damages, losses, theft, late-return fees, cleaning fees, or other costs incurred. You will be notified via text message and/or email before any such charge is processed.

Cancellation and Refund Policy

  • Cancellations made less than 24 hours before the scheduled delivery time are non-refundable.
  • Cancellations made more than 24 hours before delivery may be eligible for a refund at Kanoa’s discretion.
  • Once equipment has been delivered, no refunds will be issued for unused rental time.

Assumption of Risk and Liability

By renting from Kanoa, you acknowledge that the use of rental gear, including but not limited to mopeds, beach gear, and related equipment, carries inherent risks. You agree to assume full responsibility for your use of the equipment and any associated risks.

Kanoa is not liable for injury, loss, or damage to persons or property arising from the use or misuse of our equipment. You further agree to indemnify and hold harmless Kanoa, its owners, employees, and affiliates from any claims or damages resulting from your use of rented items.

Service Limitations and Updates

While we always aim to provide reliable service, Kanoa is not responsible for any damages, delays, or losses resulting from the use of our platform or equipment. We may update these Terms from time to time, and your continued use of our services means you agree to those changes.

Governing Law

These Terms and the Moped Rental Agreement & Liability Waiver are governed by and construed in accordance with the laws of the State of Hawaiʻi. Any disputes shall be resolved exclusively in the courts of Honolulu County, Hawaiʻi.

SMS Privacy Policy

Kanoa may disclose Personal Data and other information as follows:

• Third Parties that Help Provide the Messaging Service:
We will not share your opt-in to an SMS short code campaign with a third party for purposes unrelated to supporting you in connection with that campaign. We may share your Personal Data with third parties that help us provide the messaging service, including, but not limited to, platform providers, phone companies, and other vendors who assist us in the delivery of text messages.

• Additional Disclosures:
 Affiliates: We may disclose the Personal Data to our affiliates or subsidiaries; however, if we do so, their use and disclosure of your Personal Data will be subject to this Policy. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
